RERA Section 18 Guidelines
Q1: Can I claim a refund if the project does not have RERA registration?
No, RERA provisions apply only to projects registered with the State RERA Authority. For unregistered projects, you must file a lawsuit or consumer complaint under the Consumer Protection Act, 2019.
Q2: Within how many days must the builder refund the amount?
As per RERA regulations, if the homebuyer decides to withdraw from the project, the promoter/builder is bound to return the amount along with interest within **45 days** from the date the refund becomes due.
Q3: How does RERA calculate the SBI MCLR rate?
Under state RERA rules, the benchmark rate is the **State Bank of India Highest Marginal Cost of Lending Rate (MCLR)** plus 2% per annum, calculated as simple interest.
