Q1: Can an employer terminate a pregnant employee?
No, Section 12 of the Maternity Benefit Act makes it strictly unlawful for an employer to discharge or dismiss a woman on account of pregnancy or during her maternity leave. Violators face up to 1 year of imprisonment.
Q2: Is work-from-home covered under the Act?
Yes. Under Section 5(5) of the Act, if the nature of the work assigned to the woman is of such character that she may perform it from home, the employer may allow her to work from home after the paid leave period on mutually agreed terms.
Q3: Does the Act apply to contractual or outsourced workers?
Yes. The Supreme Court of India has held that the Maternity Benefit Act is a social welfare legislation and applies equally to contractual, ad-hoc, temporary, or daily wage female workers in both government and private sectors.
