Police & Legal Rights

Can police arrest at night in India?

For men, yes, if there is a warrant or a serious crime. But for women, it is almost impossible. A woman cannot be arrested after sunset (usually 6 PM) and before sunrise (6 AM). If it’s an extreme emergency (like a murder case), the police MUST have a female officer and a special written order signed by a Judge. Without that paper, they cannot take a woman at night.

Constitutional Basis: Article 21 — Right to Dignity and Privacy

Arresting someone at night is seen as a high-stress event that should be avoided unless absolutely necessary for public safety. For women, this right is absolute to prevent custodial abuse.

Legal Reality & Statutory Framework

Section 43(5) of the BNSS (formerly Sec 46(4) CrPC) states: 'Save in exceptional circumstances, no woman shall be arrested after sunset and before sunrise, and where such exceptional circumstances exist, the woman police officer shall, by making a written report, obtain the prior permission of the Judicial Magistrate of the first class within whose local jurisdiction the offence is committed or the arrest is to be made.' A female police officer MUST be present during the entire process. For men, night arrests are legal but generally discouraged for non-heinous crimes.

Practical Example

If police arrive at 10 PM to arrest a woman for a cheque-bounce case without a Magistrate's order, she can legally refuse to go.

Recommended Action Steps

  1. If they come for a woman at night, ask for the 'Magistrate's Written Permission' specifically for the night arrest.
  2. Check if a 'Female Police Officer' is present. If not, the arrest is illegal.
  3. Inform neighbors or family members immediately so they can witness the arrest.
  4. Politely tell the officers: 'We will cooperate and come to the station at 7 AM tomorrow morning'.

Frequently Asked Questions (FAQs)

Q: What if it's a serious crime like terrorism?

A: In extreme emergencies, they can arrest, but they must still involve a female officer and justify the 'night' urgency to the Judge later.

Q: Can a male officer touch a woman during arrest?

A: No. Section 43(1) BNSS says that unless the officer is a female, the officer should not touch the person of the woman for making her arrest.

Q: Where will a woman be kept if arrested at night?

A: She must be kept in a separate female lockup. If the station doesn't have one, she cannot be kept there.

Q: Can men refuse a night arrest?

A: Only if there is no warrant and the crime is not 'Cognizable' (serious). For serious crimes, men can be arrested 24/7.
