Q: Can the police arrest me without a warrant?
A: Only for 'Cognizable' offenses (serious crimes like theft or assault). For minor offenses, they NEED a warrant signed by a Magistrate.
Q: Can a woman be arrested at night?
A: No. Under Section 43(5) BNSS, a woman cannot generally be arrested after sunset and before sunrise, except in exceptional circumstances with prior permission from a Judicial Magistrate.
Q: What is my right after arrest?
A: You must be produced before a Magistrate within 24 hours. You also have the right to inform a family member and consult a lawyer immediately.
Q: Can I refuse to answer police questions?
A: Yes, under Article 20(3), you have the right against self-incrimination. You can remain silent until you speak to a lawyer.
