BNS Section 358

BNS Section 358: Repeal and Savings

Equivalent Legacy Law: IPC Section -

💡 Simplified Explanation

BNS Section 358 defines the rules, regulations, and penalties regarding: "repeal and savings". This section is part of the updated criminal code of India (BNS, 2023) which modernized the legal framework.

Real-World Scenario

"If an individual is found violating the provisions regarding repeal and savings as defined under this Section, they will be charged under BNS Section 358 instead of the old IPC sections."

📜 Official Statutory Provision

This section is a new addition. The Indian Penal Code, 1860, was enacted by the British Colonisers de novo; therefore, the Repeal and Savings Section was not required at all. Vide sub-section(1) and subsequent Government of India notifications, the IPC will be repealed on 1st July 2024. However, sub-sections (2) to (4) stipulate savings related to the repealed code.
