BNS Section 140: (1) Kidnapping or abducting in order to murder, etc (Legacy IPC Section 364)

Kidnapping or abducting in order to murder

  • Bailable Status: Non-bailable (Bail can only be granted by the Judiciary)
  • Cognizable Status: Cognizable (Police can arrest without warrant)
  • Triable Court: Court of Session
  • Official Punishment: Imprisonment for life, or rigorous imprisonment for 10 years and fine

Kidnapping for ransom, etc.

  • Bailable Status: Non-bailable (Bail can only be granted by the Judiciary)
  • Cognizable Status: Cognizable (Police can arrest without warrant)
  • Triable Court: Court of Session
  • Official Punishment: Death, or imprisonment for life and fine

Kidnapping or abducting with intent secretly and wrongfully to confine a person

  • Bailable Status: Non-bailable (Bail can only be granted by the Judiciary)
  • Cognizable Status: Cognizable (Police can arrest without warrant)
  • Triable Court: Magistrate of the first class
  • Official Punishment: Imprisonment for 7 years and fine

Kidnapping or abducting in order to subject a person to grievous hurt, slavery, etc.
