Article 312 represents a significant federal feature. Under clause (1), the power to initiate the creation of an All-India Service is vested in the Rajya Sabha (Council of States) via a resolution supported by a special majority (2/3rd of members present and voting). This protects state autonomy. Clause (2) deems the pre-existing IAS and IPS as services created under this article. Clauses (3) and (4) deal with the proposed All-India Judicial Service (AIJS), specifying that it cannot include posts below a District Judge and its creation does not constitute an amendment under Article 368.
